FERRET-SPECIALIST COMMISSION
TERMS OF SERVICE
Reading, understanding, and agreeing to these terms in full is REQUIRED for all commissions. You can agree to these terms by signing all documents provided to you by Ferret-Specialist with an electronic signature. “Ferret-Specialist” will be used to refer to Erick Rodriguez. Erick Rodriguez and “Ferret-Specialist” are the same person. These terms apply even if the online username in use is different from “Ferret-Specialist” or “Erick Rodriguez”.ARTWORK RIGHTSCommissioning artwork from Ferret-Specialist grants you a limited license to use, modify, print, and display the artwork for personal non-commercial purposes, commercial use licenses are available for an additional fee. Please disclose ahead of time if your commission will be used for commercial purposes. Commercial licenses contain the right to use the artwork for commercial purposes as well as the rights the non-commercial licenses have. Purchasing artwork of any kind from Ferret-Specialist does not grant you full rights to the image. Rights for any “characters”, Copyrighted Material, Trademarks, Patents, Intellectual Property, or any legally owned properties that are owned by you or any other person(s) and/or entities are retained by the rightful owners. All rights for the artwork are reserved by Ferret-Specialist. Unlawful use of the artwork is not permitted. In the event that you are selling or transferring the rights/ownership to your “characters”, Copyrighted Material, Trademarks, Patents, Intellectual Property, etc., which appear in artwork commissioned by Ferret-Specialist, you must notify the new owner of their rights in the artwork. You may provide the new owner with a copy of this document. By commissioning Ferret-Specialist, you grant Ferret-Specialist full authorization for use of the artwork in any manner and to any extent.
You may request to remain anonymous when any commissioned artwork is displayed by Ferret-Specialist in a public space. You may request for Ferret-Specialist to not display the commissioned artwork in public spaces.COMMUNICATIONPlease let Ferret-Specialist what type of commission you want prior to sending payment. Additional fees may apply if you request Ferret-Specialist to design a character for you. You may request Ferret-Specialist to take “artistic liberty” with the commission. Artistic liberty may only be done if you have provided Ferret-Specialist with an acceptable reference image or description, or if you wish to have Ferret-Specialist create a character design for you.
If Ferret-Specialist attempts to contact you, but you do not respond within one week, Ferret-Specialist may move on to the next commission on the queue and may not continue working on your commission until after the new commission is finished. If you do not respond within two weeks a refund will be issued for the amount owed.
You must notify Ferret-Specialist of any deadlines for your commission prior to Ferret-Specialist starting progress on the commission. Ferret-Specialist reserves the right to decline commissions that require deadlines. Extra fees may be applied if the deadline date is considered to be soon/early by Ferret-Specialist. Ferret-Specialist’s queue is typically done on a first-come, first-served basis.EDITS AND CRITIQUESCommissioned artwork has 4 main stages (listed from first to last): Sketch, Lineart, Flats, and Painting. You may request edits for the Sketch, Lineart, and Flats stages after Ferret-Specialist provides progress updates to you. Edits cannot be made after the commission is finalized without an additional fee. Ferret-Specialist can refuse to do any edits after the commission has been finalized. Several and/or large edits may result in higher fees being charged and may be refused by Ferret-Specialist. Feedback given must be constructive and relevant. Insulting is not a form of feedback and will not be permitted. Edits and other such changes may increase the amount of time required to complete the commission. Edits done for a commission with an early deadline may require additional fees to be charged. Ferret-Specialist has the right to refuse any edits and/or changes.PAYMENTS AND REFUNDSAll payments must be paid in full unless a different payment schedule has been agreed to with Ferret-Specialist. If you wish to request a refund after having sent the payment and Ferret-Specialist has not begun working on the commission yet, 5% of the commission payment will be kept by Ferret-Specialist as a non-refundable fee. If you request a refund after Ferret-Specialist has begun working on the commission, you will receive a refund for the portions of the commission that Ferret-Specialist has not yet begun working on (Example: You ordered a Painting commission and want a refund, Ferret-Specialist has already begun working on the Sketch, you will receive a refund for the Lineart, Flats, and Painting but not the Sketch). Refunds requested by you will not be issued if Ferret-Specialist has completed 75% or more of the commission. If Ferret-Specialist cancels your commission, the 5% fee will be waived and you will receive a full refund. Violating the Terms of Service will result in the cancellation of the commission with a non-refundable 5% fee and a refund of any portions of the commission Ferret-Specialist has not yet begun working on. An additional fee may apply if certain aspects of the commission are complex or difficult to execute. PayPal is used as the payment service for the commission process but other payment services may be used if both you and Ferret-Specialist agree to do so (such as Zelle, or other non cash forms of payment). Ferret-Specialist may refuse to use different payment methods. Payment must be sent within 7 days of agreeing to the Terms of Service. You will be added onto the queue once Ferret-Specialist has received the payment. Failure to send payment within 7 days will be considered a cancellation and Ferret-Specialist will not move forward with your commission. You may need to begin the commission process from the beginning if you fail to send the payment within 7 days. You may be moved lower on the queue if you fail to send payment within 7 days and you still wish to continue the commission process. If you fail to send the payment a second time, Ferret-Specialist may refuse to work with you and may refuse any current or future commission requests.LEGAL AND VIOLATION OF TERMSViolating the Terms of Service can result in cancellation of all commissions. Any fraudulent practices, copyright infringement, violations of these terms, theft, any physical, digital, and/or emotional harm/damage, threats, illegal activity, falsified information, misuse of any financial data, funds, cash, and/or credit (this includes but is not limited to misuse of PayPal chargebacks), or any similar unlawful or negative actions committed by you or your party can result in cancellation of all commissions.
If any part of the Terms of Service is in conflict with any existing law or if a legal authority mandates the part to be voided, the specific part of the Terms of Service that is in conflict will be voided. Any portion of the Terms of Service can be voided and/or changed by Ferret-Specialist at any time for any reason with the exception of such actions being in conflict with the law. By agreeing to the Terms of Service, for any claims under these terms, you agree to have all liabilities of Ferret-Specialist be limited to the amount you have paid for the services provided. You agree Ferret-Specialist will not be held liable or responsible for any damages, loss, or similar liabilities caused by the commission and/or commission process. These terms are to the extent permitted by law, when permitted by law.
Ferret-Specialist has the right to refuse service to anyone. The Terms of Service are subject to change at any time without notice. If any terms in this document contradict or are in conflict with each other, Ferret-Specialist may decide which term is enforced and which is not. If any terms in this document contradict or are in conflict with the payment service’s terms, then the payment service’s terms will have priority
You must be 18 years of age or older to commission any adult artwork. If your country, state, county, or city requires you to be older than 18 years of age to be considered a legal adult, then you will be required to be the minimum age required to be a legal adult in that specific area to commission adult artwork. You must wait at least one day after your date of birth to commission adult artwork if you have just turned 18 years old. Lying about your age is considered a violation of these terms.
Certain aspects of this document may be outside of their proper section, this does not void those sections nor those aspects of the document. The sections in this document (Example: “Artwork Rights”) are provided for your convenience and the sections may contain content meant to be in other sections or content that may not have any specified section.
